Welcome to www.eatfeirabrasil.com. These Terms and Conditions (“Terms”) govern your use of the Feira Brasil website and your purchase or booking of food-truck, catering, and related services from Feira Brasil (“Feira Brasil,” “we,” “our,” or “us”).

By using our website, placing an order, accepting a proposal, paying a deposit, or booking our services, you agree to these Terms.

Feira Brasil provides mobile food-truck service, catering, event food service, and related products and services.

Service availability may depend on:

• Your location
• Event date and time
• Guest count
• Menu selection
• Venue access
• Parking and food-truck space
• Local permits and regulations
• Staffing and product availability

Submitting an inquiry does not guarantee availability or create a confirmed reservation.

Catering prices shown on our website or in marketing materials are estimates unless specifically stated otherwise.

A catering reservation is not confirmed until:

1. Feira Brasil approves the event details;
2. The customer accepts the final proposal or catering agreement; and
3. The required deposit is successfully paid.

Quotes are valid for 30 days unless otherwise stated. Prices may change if the guest count, menu, service time, location, staffing, rentals, or other event requirements change.

If an event proposal or signed catering agreement conflicts with these website Terms, the event-specific agreement will control.

A nonrefundable reservation deposit of 50% is required to secure an event date unless otherwise stated in writing.

The remaining balance is due 3 days before the event. Bookings made within that period may require full payment at the time of confirmation.

Feira Brasil may cancel or decline service if required payments are not received by their deadlines. The customer is responsible for applicable taxes and any agreed delivery, travel, staffing, setup, rental, service, parking, or permit charges.

Any gratuity will be identified separately. A service charge is not necessarily a gratuity and may be used to cover administrative and operational expenses.

The customer must provide a final guaranteed guest count no later than 3 days before the event.

After that deadline:

• The guaranteed guest count may not be reduced;
• Increases are subject to availability and additional charges; and
• Significant increases may require changes to staffing, service time, or menu selections.

Menu and event changes must be requested in writing and are not effective until confirmed by Feira Brasil.

All cancellations must be submitted in writing.

Unless an event-specific agreement states otherwise, the following cancellation policy applies:

• More than 15 days before the event: payments may be refunded, less the nonrefundable deposit and any costs already incurred.
• Between 5 and 15 days before the event: the customer is responsible for 50% of the total contracted amount.
• Fewer than 5 days before the event: all payments are nonrefundable, and the full contracted amount may remain due.

Costs already incurred may include specially ordered food, supplies, rentals, permits, staffing commitments, travel arrangements, and other event-related expenses.

Failure to attend, provide access, or make the venue available does not qualify for a refund.

Any cancellation rights required by applicable law will remain in effect regardless of this policy.

Requests to reschedule are subject to our availability and must be made in writing.

Payments may be transferred to a new date at our discretion if:

• The new event occurs within 2 months of the original date;
• Feira Brasil is available;
• The request is received before nonrecoverable expenses are incurred; and
• The customer pays any pricing difference or rescheduling fee.

A requested date change is not confirmed until Feira Brasil provides written approval.

Food-truck locations, schedules, operating hours, and menu availability may change without notice due to weather, mechanical issues, private bookings, permit requirements, ingredient availability, or other operational circumstances.

For private food-truck events, the customer must provide:

• Safe and legal vehicle access;
• A level parking space large enough for the truck;
• Reasonable setup and departure access;
• Any venue or property-owner approval;
• Adequate clearance from buildings, fire lanes, and hazards; and
• Any customer-responsible permits, parking arrangements, or utility access identified in the proposal.

Feira Brasil may refuse to park or operate where conditions are unsafe, inaccessible, unlawful, or likely to damage the vehicle or property.

Private food-truck events may be subject to a minimum purchase, minimum guest count, travel fee, or minimum service charge specified in the event proposal.

The customer is responsible for providing accurate event details and obtaining permission for Feira Brasil to operate at the event location.

Unless agreed otherwise, the customer is responsible for:

• Venue approval and site access;
• Guest seating and dining areas;
• Parking charges and access fees;
• Customer-required permits;
• Adequate lighting and security;
• Waste disposal arrangements;
• Access to electricity or water when specified; and
• A safe environment for our employees, equipment, and vehicle.

Delays caused by blocked access, unavailable facilities, venue restrictions, or inaccurate information may reduce service time and may result in additional charges.

Service begins and ends at the times stated in the event agreement.

Requests to extend service are subject to staffing, food availability, venue restrictions, and our approval. Additional time may be charged at $50 per hour or partial hour.

Late guest arrival does not automatically extend the agreed service period.

We make reasonable efforts to provide the agreed menu. However, ingredients and products may become unavailable because of supply interruptions, quality concerns, market conditions, or circumstances beyond our control.

When necessary, Feira Brasil may substitute an item with one of comparable quality and value. We will attempt to notify the customer when a substantial substitution is required.

Photographs on our website and marketing materials are for presentation purposes. Actual portions, ingredients, packaging, and appearance may vary.

Customers must inform Feira Brasil in writing about food allergies and dietary requirements before the applicable ordering deadline.

Although we take reasonable precautions, our food may be prepared, cooked, stored, or served in facilities and equipment that handle common allergens, including milk, eggs, wheat, soy, peanuts, tree nuts, fish, shellfish, and sesame.

We cannot guarantee that any item is completely free from allergens or cross-contact. Customers and guests with severe allergies should speak directly with Feira Brasil before ordering and make decisions appropriate to their individual medical needs.

For safety and quality, food should be consumed within the recommended service period.

Once food has been delivered, served, displayed, removed from temperature control, or transferred to the customer, the customer assumes responsibility for its proper handling, storage, refrigeration, reheating, and disposal.

Feira Brasil may decline to release certain leftovers when doing so could create a food-safety risk. If leftovers are released, Feira Brasil is not responsible for illness, spoilage, or loss resulting from improper handling or storage after service.

The customer is responsible for providing suitable protection from rain, wind, heat, cold, and other outdoor conditions when required for catering service.

The food truck cannot operate when weather, ground conditions, road conditions, flooding, high winds, lightning, government warnings, or other circumstances make travel or operation unsafe.

If weather affects an event, the cancellation or rescheduling provisions in these Terms and the event agreement will apply unless otherwise agreed in writing.

Neither party will be liable for a delay or failure caused by circumstances beyond reasonable control, including severe weather, natural disasters, fire, flood, epidemic, government action, road closure, utility failure, labor disruption, supply interruption, civil disturbance, or vehicle breakdown.

If Feira Brasil cannot perform because of such circumstances, we may offer rescheduling, substitute service, or a refund of amounts paid for services not provided, less nonrecoverable expenses, as permitted by law.

All orders are subject to acceptance and availability. We may correct pricing, description, or availability errors before accepting an order.

Payments may be processed by an independent payment provider. Use of that provider may also be subject to its terms and privacy policy.

The customer represents that they are authorized to use the selected payment method and authorizes all applicable charges.

Customers and guests must treat Feira Brasil employees and contractors respectfully and must not create an unsafe, threatening, abusive, discriminatory, or unlawful environment.

We may suspend or end service if unsafe or inappropriate conduct occurs. In such cases, payments may remain nonrefundable to the extent permitted by law.

The customer is responsible for damage to Feira Brasil property caused by the customer, the venue, or the customer’s guests, excluding ordinary wear and tear.

You may use our website only for lawful personal or business purposes. You may not:

• Interfere with the website’s operation or security;
• Attempt to gain unauthorized access to our systems;
• Introduce viruses or harmful code;
• Scrape or copy website content through automated means;
• Misrepresent your identity;
• Use the website for fraudulent or unlawful activity; or
• Copy or commercially exploit our content without permission.

We may restrict or terminate website access when these Terms are violated.

The Feira Brasil name, logos, photographs, graphics, website text, menu designs, and other original content are owned by or licensed to Feira Brasil and are protected by applicable intellectual-property laws.

You may not reproduce, modify, publish, sell, or commercially use this content without our written permission.

Our website may link to third-party ordering platforms, payment processors, social networks, maps, or other services.

Feira Brasil does not control those services and is not responsible for their availability, content, security, policies, or practices. Your use of a third-party service is governed by that provider’s terms.

To the fullest extent permitted by law, our website and its general content are provided “as is” and “as available.” We do not guarantee that the website will always be uninterrupted, error-free, or completely secure.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

To the fullest extent permitted by law, Feira Brasil will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the website, an order, or our services.

Feira Brasil’s total liability arising from a particular order or event will not exceed the amount the customer paid to Feira Brasil for that order or event.

These limitations do not apply where liability cannot legally be limited or excluded.

To the extent permitted by law, the customer agrees to indemnify and hold Feira Brasil harmless from third-party claims, losses, or expenses arising from:

• The customer’s breach of these Terms;
• Unsafe or unlawful venue conditions;
• Inaccurate event information supplied by the customer;
• Conduct by the customer or the customer’s guests; or
• Improper handling or storage of food after it is transferred to the customer.

This section does not require the customer to indemnify Feira Brasil for Feira Brasil’s own negligence or unlawful conduct.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Any legal action must be brought in a court of competent jurisdiction located in Harris County, TX, unless applicable law requires otherwise.

Before filing a claim, the parties agree to make a good-faith effort to resolve the dispute directly.

We may update these Terms periodically. Updated Terms will be posted on this page with a revised effective date.

Changes will not retroactively alter a confirmed catering agreement unless both parties agree in writing or the change is required by law.

If any portion of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.

These Terms, together with any accepted proposal, invoice, catering agreement, and incorporated policies, form the agreement between the customer and Feira Brasil concerning the applicable services.

Any amendment to an event-specific agreement must be confirmed in writing.
